Article 12 – Intellectual Property
All elements of the website (texts, images, videos, logos, brands, etc.) are the exclusive property of MINT YOUR CARD or its partners and are protected by intellectual property law.
Any reproduction, representation, modification or use, even partial, of elements of the website is prohibited without prior written authorisation.
Article 13 – Liability
MINT YOUR CARD shall not be held liable for failure to comply with these Terms of Service resulting from a force majeure event or the act of a third party.
The company is not liable for indirect damages such as loss of data, loss of profits or commercial loss.
Article 14 – Disputes
14.1 Mediation
In the event of a dispute, the buyer may have recourse to conventional mediation with:
- The Economic Mediation service of the Paris Chamber of Commerce and Industry
- The Consumer Mediation Commission
14.2 Jurisdiction
These Terms of Service are governed by French law. Any dispute not resolved amicably shall fall under the exclusive jurisdiction of the Commercial Courts of Paris.
Article 15 – Evidence
The computerised records stored in MINT YOUR CARD's IT systems under reasonable security conditions shall be considered as proof of the communications, orders and payments made between the parties.
Article 16 – Nature and Limits of Community Pre-Grading
16.1 Scope of service
The MYC pre-grade is a service for evaluating the visual condition of a card (centering, surface, corners, edges) performed by the user community based on the photos and video provided by the card owner. The grade awarded reflects only the apparent condition of the card at the time of submission.
16.2 Express exclusions
The pre-grading service does not include:
- Authentication of the card (authenticity, counterfeit, reproduction, fraudulent printing)
- Detection of physical alterations (trimming, recoloring, resealing, erasing, restoration)
- Professional certification within the meaning of PSA, CGC, BGS or any other professional grading service
- Any guarantee of market value, resale price or capital gain
- Equivalence with a grade awarded by a professional grading service
16.3 Liability
MINT YOUR CARD shall not be held liable for:
- The authenticity of cards submitted for pre-grading
- Discrepancies between the MYC community grade and any subsequent grade awarded by a professional grading service
- The subjectivity inherent in community voting
- Any physical handling of the card after submission
- Purchase, sale or investment decisions made on the basis of a community grade
The user acknowledges that the MYC grade is a community indicator and not an official certification.
Article 17 – Use of Physical Protections (Sleeves and Cardsavers)
17.1 Nature of products
The sleeves and cardsavers sold by MINT YOUR CARD are physical protections bearing the MYC logo, a unique serial number (CS format for cardsavers, SL format for sleeves), a QR code and a dedicated area to receive a grade sticker.
17.2 Sealing and video evidence
To benefit from pre-grading with sealing, the owner films the card continuously and seals it inside the protection on camera. This video constitutes proof that the card presented corresponds to the card sealed. The quality of this evidence depends solely on how the video is made by the user.
17.3 Serial number and QR code
Each protection carries a unique serial number linked to the card record in the application. The QR code provides access to the public report of the card (grading, photos, video). MINT YOUR CARD uses its best efforts to keep these reports online, without being able to guarantee their permanent availability in the event of service modification or discontinuation.
17.4 Grade sticker
The grade sticker is applied by the user to the designated area of the protection once the community grade has been awarded. Its application is solely the user's responsibility. MINT YOUR CARD shall not be held liable for application errors, peeling or subsequent alteration of the sticker.
17.5 Post-sealing tampering
A sealed card may be subject to tampering or substitution after submission (opening and resealing of the protection, substitution of the card). MINT YOUR CARD cannot detect such tampering and shall not be held liable for it.
17.6 Traceability and cooperation with authorities
MINT YOUR CARD retains the history of successive owners of each card registered on the platform, together with the evidence linked to the submission (photos, sealing video, timestamp, serial number, identity of the user who performed the initial sealing). This information is never shared with other users.
Such data is retained throughout the lifetime of the card on the platform, as well as during the applicable limitation periods (in particular civil and criminal limitation periods), in order to allow their use as evidence in the event of dispute or investigation.
Upon a valid request from a competent authority (police or gendarmerie services, judicial authority, bailiff) or in execution of a court decision — in particular under Article 145 of the French Code of Civil Procedure, or by any other legal means provided by law — MINT YOUR CARD cooperates by providing the information and evidence useful to the investigation, including the identity and contact details of the successive owners of a card and of the user who carried out the initial sealing.
This traceability helps deter and sanction fraudulent practices (theft, counterfeit, substitution) and protects good-faith buyers.
Article 18 – User Account and Application
18.1 Account creation
Access to the Mint Your Card application (web, iOS, Android) requires the creation of a user account. The user undertakes to provide accurate information and to keep their credentials confidential.
18.2 User obligations
The user undertakes not to:
- Impersonate a third party
- Submit counterfeit cards, stolen cards or cards they do not own
- Manipulate the grading system (coordinated voting, fake accounts, collusion)
- Attempt to gain unauthorized access to MINT YOUR CARD's systems
- Use the application for illegal purposes or purposes contrary to public decency
18.3 Account suspension and closure
MINT YOUR CARD reserves the right to suspend or close any account in the event of breach of these Terms of Service, suspected fraud, or compromise to the security of the platform, without notice where the severity so warrants.
18.4 User content
By submitting photos, videos or text on the platform, the user grants MINT YOUR CARD a non-exclusive, worldwide, royalty-free licence to use such content in the context of the operation of the service (report display, verification, moderation). The user warrants that they hold the necessary rights to the submitted content.
18.5 Service availability
MINT YOUR CARD uses its best efforts to keep the application accessible 24 hours a day, 7 days a week, without being able to guarantee uninterrupted availability. Maintenance operations, updates, technical incidents or force majeure events may result in temporary unavailability without engaging the liability of MINT YOUR CARD.
Article 19 – Mints (In-App Virtual Currency)
19.1 Nature
Mints are a virtual currency internal to the Mint Your Card application, usable only within the service. They have no monetary value, cannot be converted into euros or any other currency, and cannot be withdrawn from the platform.
19.2 Acquisition
Mints are earned by the user through their actions on the platform (grading cards, sponsorship, card submissions, weekly leaderboards). They are not offered for sale and cannot be purchased.
19.3 Use
Mints may be used to:
- Obtain physical products (sleeves, cardsavers) added to a shop order
- Unlock cosmetic items within the application (frames, banners, favorite badges, animations)
19.4 Non-refundable and non-transferable
Mints are strictly personal. They may not be transferred between users, assigned, sold, or refunded in cash. Products or cosmetics obtained with Mints shall not give rise to any monetary refund.
19.5 Account closure and service discontinuation
In the event of account closure (voluntary or for breach of the Terms of Service) or in the event of discontinuation of the service, accumulated Mints are permanently forfeited without compensation. MINT YOUR CARD reserves the right to modify the Mints system (earning rate, available products, usage terms) at any time.
Article 20 – Miscellaneous Provisions
20.1 Modification of the Terms of Service
MINT YOUR CARD reserves the right to modify these Terms of Service at any time. Modifications take effect upon their publication on the website. Users are informed of substantial changes by email or in-app notification. Continued use of the service after notification constitutes acceptance of the new Terms of Service.
20.2 Partial invalidity
If any provision of these Terms of Service is held to be void or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
20.3 Language of contract
These Terms of Service are drafted in French. In the event of translation into another language, only the French version shall prevail in the event of contradiction.
20.4 Entire agreement
These Terms of Service, together with the Privacy Policy and, where applicable, any specific terms applying to particular services, constitute the entire agreement between MINT YOUR CARD and the user.
